Cast & Clay specializes in handcrafted ceramic fishing mugs and bowls, custom glazed pottery for outdoor use, collectible glass fish sculptures, bespoke ceramic tackle organizers, and nature-inspired glass art installations. Our commitment is to provide unique, high-quality artisanal goods, and these terms ensure a clear and fair relationship for all.

2. Website Use

2.1. You must be at least 18 years old to use this website. By using our site, you represent that you are of legal age.

3. Product Sales & Payment

3.1. All product descriptions and pricing are subject to change without notice. We reserve the right at any time to modify or discontinue any product without notice.

3.2. We endeavor to display as accurately as possible the colors and images of our products. However, as each piece is handcrafted, slight variations in color, size, and form are natural and part of the unique appeal. We cannot guarantee that your device's display of any color will be accurate.

3.3. Payment for all standard product orders must be made in full at the time of purchase through our secure online payment portal. We accept major credit cards and other payment methods as indicated on our website.

3.4. All prices are listed in USD and do not include applicable taxes or shipping charges unless explicitly stated.

4. Shipping & Delivery Policy

4.1. We aim to process and ship standard orders within 3-5 business days. Custom orders will have specific lead times communicated at the time of order confirmation.

4.2. Shipping costs will be calculated at checkout based on the weight, dimensions, and destination of your order. We primarily ship within the continental United States.

4.3. Cast & Clay is not responsible for delays in shipping caused by carriers or unforeseen circumstances once the item has left our studio.

4.4. Risk of loss and title for items purchased from Cast & Clay pass to you upon our delivery to the carrier.

5. Returns & Refunds Policy

5.1. **Standard Products:** For non-customized, standard items, you may return them within 14 days of receipt for a full refund or exchange, provided the items are unused, in their original condition, and with all original packaging. Customers are responsible for return shipping costs.

5.2. **Custom Orders:** Due to their personalized nature, all custom-commissioned pottery, glass art, tackle organizers, and bespoke glaze pieces are considered final sale and are non-refundable and non-exchangeable once production has begun. We strive for customer satisfaction and will work with you during the design and approval process to ensure your vision is met before final creation.

5.3. **Damaged Goods:** If an item arrives damaged, please contact us immediately at info@castclayrixel.com with photographic evidence of the damage and original packaging within 48 hours of delivery. We will facilitate a replacement or refund as appropriate.

6. Custom Orders

6.1. **Deposit:** A non-refundable deposit of 50% of the estimated total cost is required to initiate any custom order project.

6.2. **Approval Process:** We will provide design sketches or digital mock-ups for your review and approval. Production will only commence after your explicit written approval. Minor adjustments can be made during this phase; however, significant changes after approval may incur additional costs and extend the lead time.

6.3. **Lead Times:** Custom order lead times vary significantly based on complexity and current studio workload. An estimated completion date will be provided with your quote. While we strive to meet these estimates, artisan work can sometimes require additional time, and we will communicate any changes promptly.

6.4. **Final Payment:** The remaining balance of your custom order is due upon completion and prior to shipping or local pickup.

7. Intellectual Property

7.1. All content on this website, including but not limited to designs, text, graphics, logos, images, software, and the compilation thereof, is the property of Cast & Clay or its content suppliers and is protected by copyright and other intellectual property laws.

7.2. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the website or its content without express written permission from Cast & Clay. This includes our unique pottery designs, glass sculptures, and branding elements.

7.3. Any custom work created by Cast & Clay remains the intellectual property of Cast & Clay, even after sale, unless otherwise agreed upon in writing.

8. Limitation of Liability

8.1. In no event shall Cast & Clay, its directors, employees, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever arising out of your use of our website or products, even if advised of the possibility of such damages.

8.2. Our total liability to you for any damages, losses, and causes of action shall not exceed the amount paid by you, if any, for accessing this site or for products or services purchased through this site.

9. Governing Law

These Terms & Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict of law provisions. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Springfield, Illinois.
